These Terms of Use (“Terms”) govern your use of the Articlo website and service provided by ETHEREUM SOLUÇÕES EM TECNOLOGIA INFORMAÇÃO LTDA (CNPJ 42.460.995/0001-13), operating as “Articlo” (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old and able to form a binding contract to use Articlo. By using the Service you represent and warrant that you meet these requirements.
2. Your account
- You are responsible for safeguarding access to your account and for all activity that occurs under it.
- You agree to provide accurate information and keep it up to date.
- You can delete your account at any time from the Settings page.
3. What Articlo does
Articlo is a software service. The Service is provided as-is and its functionality may evolve over time. Output quality may depend on the inputs you provide and on third-party providers we rely on.
4. Acceptable use
You agree not to:
- Use the Service in a way that violates any law or third-party rights.
- Attempt to reverse engineer, scrape, or abuse the Service or circumvent security.
- Upload content that is illegal, infringing, harmful, or that you do not have the rights to submit.
- Use the Service to harass, defraud, or harm others.
- Resell or sublicense the Service without our written permission.
5. Your content
You retain all rights to the content you upload. You grant us a limited, worldwide, royalty-free license to host, process, and display your content solely as needed to operate and improve the Service.
6. Plans, billing & refunds
- Paid plans are billed in advance on a recurring basis. Prices are listed on the pricing page.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.
- We may change pricing with at least 30 days’ notice before your next renewal.
7. Intellectual property
The Service, including software, design, text, and branding, is owned by ETHEREUM SOLUÇÕES EM TECNOLOGIA INFORMAÇÃO LTDA and protected by intellectual property laws.
8. Third-party services
Articlo integrates with third-party providers (hosting, authentication, payments, AI providers, and others). We are not responsible for third-party service outages or changes.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETHEREUM SOLUÇÕES EM TECNOLOGIA INFORMAÇÃO LTDA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR US$100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ETHEREUM SOLUÇÕES EM TECNOLOGIA INFORMAÇÃO LTDA, its officers, employees, and agents from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.
12. Termination
You can stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we need to do so for legal, security, or operational reasons.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved in the competent courts of Brazil, unless you are a consumer entitled to the protection of mandatory laws of your country of residence.
